How to Make a Claim
Workers compensation claims are governed by the Workers Rehabilitation and Compensation Act 1988 (Tas). The process involves two key steps.
Step 1: Notify Your Employer
You must notify your employer of your injury “as soon as practicable”.
- Notice can be oral or in writing
- It may be given to a supervisor or authorised person
- The employer must advise that you may have a right to claim
Providing notice does not constitute a claim.
Step 2: Lodge a Claim
To make a valid claim:
- Complete the approved form:
- Provide a Certificate of Capacity:
A claim is valid only once both documents are provided.
Time Limits
Claims must usually be made within six months of the injury. Extensions may apply in certain circumstances.
What Happens Next
Once a claim is lodged:
- The employer has 84 days to accept or dispute liability
- Weekly payments and treatment costs may be payable during this period
If liability is disputed, payments may cease, but the claim can still be pursued.
Disputed Claims (TASCAT)
Disputes may proceed to the Tasmanian Civil and Administrative Appeals Tribunal (TASCAT).
- Employers must provide written reasons for disputing a claim
- Failure to do so may result in liability being deemed accepted
